ICC Global Principles for Effective Border Carbon Adjustments

We are pleased to announce the launch of the «ICC Global Principles for Effective Border Carbon Adjustments.» This work follows weeks of extensive consultations with ICC experts to provide key recommendations for governments on designing effective Border Carbon Adjustment (BCA) regimes, ensuring a coherent, fair and multilateral approach.

We sincerely thank the members of the relevant ICC Policy Commissions, Carbon Pricing Working Group and National Committees for their valuable contributions, expertise, and active engagement in developing this important work.

Context
This initiative builds on the experience of companies during the EU Carbon Border Adjustment Mechanism rollout. We recognise the challenges of carbon leakage caused by differences in domestic climate policies. With many major economies now developing similar measures, there is, however, a growing risk of creating a fragmented landscape, particularly affecting developing markets and small businesses.

ICC Secretary General John W.H. Denton AO said earlier today: “Border carbon adjustments must be designed in a way to advance climate goals, foster fair competition and promote international commerce. And, crucially, they must not constitute – or be perceived as – a means of arbitrary discrimination or disguised protectionism.”

In response to the urgency of these issues, ICC developed its Global Principles for Effective Border Carbon Adjustments.

These principles aim to guide the development and implementation of effective BCA measures aligned with multilateral goals. ICC is urging the Group of 20 to start a global dialogue, bringing together WTO members and parties to the UNFCCC and the Paris Agreement to address this agenda without delay.

The International Chamber of Commerce (ICC) has launched a new set of Principles for Sustainable Trade Finance (PSTF) at Sibos 2024 in Beijing.

Developed in collaboration with industry experts, financial institutions, corporates and Boston Consulting Group (BCG), the PSTF aim to provide a consensus set of principles that define sustainable trade finance products.

We are delighted to announce the launch of the ICC Principles for Sustainable Trade: Wave 3 (PST), which have been developed under the auspices of the ICC Global Banking/Environment & Energy Commissions, drawing expertise from over 200 banks, corporates and technology players over the past year.  A copy of the ICC Principles for Sustainable Trade is attached here for your reference and the accompanying press release is available here.

ICC Antitrust Compliance Toolkit (2024)

The Toolkit is now available on the ICC website and can be downloaded free of charge.

Published with the endorsement of Olivier Guersent, Director General for Competition at the European Commission, the Toolkit was updated to reflect changes that have taken place over the last decade in antitrust compliance programmes, the developing views of antitrust enforcement agencies, as well as recent developments in areas of antitrust risk.  

Broken down into ten chapters, the Toolkit provides the core principles to build a robust antitrust compliance programme.  It includes insights and tips on how to conduct risk assessment, some guidance on the use of Artificial Intelligence as a detection tool in internal compliance investigations, and what red flags to look out for.

The core elements to a credible corporate compliance programme featured in the ICC Toolkit are:

1. Compliance embedded as company culture and policy
2. Compliance organization and resources
3. Risk identification and assessment
4. Antitrust compliance know-how
5. Antitrust concerns-handling systems
6. Handling of internal investigations
7. Disciplinary action
8. Antitrust due diligence
9. Compliance incentives
10. Monitoring and continuous improvement

We strongly invite you to read the new Toolkit which has been streamlined to make it more concise and user-friendly to the users, be they in-house legal teams, compliance officers, external counsel, business leaders, and policymakers.  Please feel free to share it with your colleagues and contacts, and/or anyone seeking to reinforce their antitrust compliance programme and policy.
